Declaration for a Semi-Inground Pool

Are you considering installing a semi-inground pool on your property? It’s an excellent choice to enhance your garden, as it blends harmoniously with the landscape.

However, be aware that this project is subject to urban planning regulations. In most cases, a prior declaration of works is mandatory. This administrative procedure allows the town hall to verify that your installation complies with local regulations, particularly the Local Urban Plan (PLU).

Why Declare a Semi-Inground Pool?

The prior declaration of works is the authorization required for intermediate-sized constructions. For a pool, it is mandatory if the pool’s surface area is between 10 m² and 100 m². Below 10 m², no authorization is necessary (except in specific cases). Beyond 100 m², you will need to apply for a building permit.

The declaration is also a condition often required by insurers. To cover your new installation against damages, your home insurance company will ask you to prove that the pool was legally constructed. This is a guarantee for both you and them.

Finally, the location of your land may require a declaration, regardless of the pool’s size. If your property is located in a protected area (near a historical monument, a remarkable heritage site, a classified site…), any modification to the exterior appearance is subject to authorization.

How to Declare Your Semi-Inground Pool?

Before starting, consult the Local Urban Plan (PLU) by inquiring with your town hall’s urban planning department. This document may set specific rules (colors, materials, distances) for your municipality.

For your declaration file, you will need to gather several documents:

The Prior Declaration Form

This is Cerfa form n° 13703. This document is specifically designed for construction projects, works, installations, and developments not subject to a building permit, including or not including demolitions for an individual house and/or its annexes. You can download it from the public service website.

The Project Plans

Your file must allow the administration to precisely visualize your project. A pool professional can provide you with the necessary technical documents. You will need to include, in particular:

  • A site plan (DP1) to locate your plot within the municipality.
  • A mass plan (DP2) showing the exact location of the pool on your property, with its dimensions and distances from property boundaries.
  • A cross-section plan (DP3) illustrating the depth of the pool and the terrain profile.
  • A representation of the exterior appearance of the pool and its surroundings (DP4).

Once the file is complete, submit it to the town hall in duplicate or send it by registered letter with acknowledgment of receipt. The processing time is generally one month. After this period, the absence of a response from the town hall constitutes non-opposition to the works. Be aware that the town hall may also oppose the project if it does not comply.
