You have just installed a wooden fence to enjoy some peace in your garden. The problem: it exceeds the authorized height. And your neighbor knows the regulations very well. The result? Every year, homeowners find themselves in this situation because they were unaware of local fencing rules. Here is what you need to know before installing the first post. <\/p>\n

What the law says about fence heights<\/h2>\n

The maximum height of a fence is not the same everywhere in France, and this is a point that many homeowners overlook. The Civil Code (Articles 663 et seq.) sets default heights: 2.60 m in cities with 50,000 inhabitants or more, and 3.20 m in smaller municipalities. However, these figures only apply if no local regulations modify them. <\/p>\n

In practice, however, this is almost always the case. Your municipality’s Local Urban Plan (PLU) may impose much lower heights, often 1.80 m or 2 m, as well as specific materials or aesthetic constraints. A housing development may also have its own regulations. The general rule is therefore not enough: you must check at the local level before starting work. <\/p>\n

The fine no one sees coming<\/h2>\n

Exceeding the regulatory height is a violation of urban planning rules. In concrete terms, the mayor can draw up an official report and demand compliance. If you do not react, you risk a fine of up to \u20ac1,200 under Article R. 610-5 of the Penal Code, which applies to violations of municipal decrees and the PLU. <\/p>\n

And that is not the worst of it. A neighbor can also take the matter to the judicial court for abnormal neighborhood disturbance, loss of sunlight, or obstructed views, and obtain an order to dismantle your fence at your expense. Add legal fees, and for a fence installed on a Saturday morning without prior verification, the bill adds up quickly. <\/p>\n

How to find out the authorized height for your property<\/h2>\n

Before ordering anything, there is only one necessary step: consult the PLU or the regulations for your zone at your town hall. You can generally access this online on the municipality’s website or through the urban planning department. Ask for the rules applicable to your specific plot, as they sometimes vary from one neighborhood to another within the same town. <\/p>\n

If your land is located in a housing development, also check the specifications. They may contain additional restrictions on the height, colors, transparency, or appearance of the fence. And if your house is near a historical monument or in a protected area, expect stricter constraints, requiring the opinion of the Architect of French Buildings (Architecte des B\u00e2timents de France). <\/p>\n

Is a prior declaration required for a fence?<\/h2>\n

Yes, in many cases. As soon as your municipality has a PLU or if you are in a protected area, installing a fence requires a prior declaration of work (Cerfa form no. 13703). It is not a building permit, but it is mandatory. The processing time is generally one month. <\/p>\n

Installing a fence without this declaration is taking an unnecessary risk. In the event of an inspection or a complaint from neighbors, the lack of a declaration worsens your situation: you are in violation for the construction itself and potentially for exceeding size limits.
