Sometimes we really want a neighbor to install a fence, whether to gain privacy or simply to stop their dog from trampling your flowerbeds. While the Civil Code allows you to enclose your land, can you require your neighbor to do the same (and pay their share)? Not always. Here is how it works in practice. <\/p>\n
Article 647 of the Civil Code sets a basic rule: every owner has the right to enclose their land. This is a fundamental freedom. However, if you decide to install a fence on your property, set back from the boundary line between the two plots, it is entirely at your own expense. <\/p>\n
The advantage is that the neighbor has no say in the color or materials. As long as you respect local urban planning regulations and do not completely block their sunlight, you are in control of your project. <\/p>\n
There is, however, one case where the law allows you to force your neighbor’s hand (Article 663 of the Civil Code). But be aware, this rule was designed for towns and their suburbs to guarantee a minimum level of tranquility. <\/p>\n
If your two plots touch and are located in a highly urbanized area, you can require your neighbor to participate in the construction and maintenance of a shared (party) fence. Conversely, if you live in the countryside or the plots are agricultural, the rule does not apply: everyone remains free to leave their land open. <\/p>\n
Before pouring the concrete, check your local municipality’s rules. The Local Urban Plan (PLU) dictates the authorized materials and the maximum height. If there is no PLU, the Civil Code takes over: boundary walls must be at least 3.20 meters high in cities with more than 50,000 inhabitants, and 2.60 meters elsewhere. <\/p>\n
Also, remember to file a prior declaration of works at the town hall. And if you live in a housing estate, take a look at the specifications (cahier des charges). It often imposes strict aesthetic constraints on fencing and privacy screens to maintain harmony in the neighborhood. <\/p>\n
If the fence is placed exactly on the boundary of your two properties, it becomes a party (shared) fence. Whether this follows an amicable agreement or the rule of forced enclosure, the bill is split in two. <\/p>\n
This cost-sharing applies to everything: the purchase of panels or mesh, labor if you hire a professional, earthworks, and maintenance over the years.<\/p>\n
Is your neighbor ignoring you even though you are in an urban area? You must first send them a formal notice by registered letter, then potentially take the matter to the local court to obtain an injunction to perform. <\/p>\n
It is better to avoid ending up in court. Before brandishing legal articles, simply go and discuss your project with your neighbor. Show them your quotes, the models being considered, and agree on a schedule. Always put this agreement in writing. <\/p>\n
If there is the slightest doubt about the exact boundary between your gardens, have a licensed surveyor perform a boundary marking. This is the only way to define the space without the risk of future litigation. <\/p>\n
