In the vast majority of French municipalities, a gate opening onto the street must not open outwards. A leaf that swings out over the pavement or roadway obstructs pedestrians, prams, people with reduced mobility and cyclists, and can injure them.  <\/p>\n<p>If your gate encroaches, even temporarily, on the public domain, you are in breach. It does not matter if \u201cthere\u2019s plenty of room\u201d or if \u201cno one complains\u201d. The day a passer-by is hit by a gate leaf, your civil liability is engaged.  <\/p>\n<h2>Penalties you may face<\/h2>\n<p>This is not a minor administrative detail. If it is reported or checked, the town hall can send you a formal notice with a deadline to bring it into compliance. If you do not act, a daily penalty payment may apply.  <\/p>\n<p>In the event of an accident, the consequences escalate: damages, covering medical costs, and even criminal proceedings for endangering others. Your home insurance may even refuse to cover the claim if the installation is not compliant. <\/p>\n<h2>How to check whether your gate is a problem<\/h2>\n<p>Before you panic, check two things:<\/p>\n<ul>\n<li><strong>Your municipality\u2019s local urban plan (PLU)<\/strong>: it sets out the rules for installing fences and gates on the property boundary. Available at the town hall or online. <\/li>\n<li><strong>The current opening direction<\/strong>: if your leaves open onto the pavement, the road or any public space, you are probably concerned, unless there is a local exception.<\/li>\n<\/ul>\n<p>If in doubt, a call to your town hall\u2019s planning department will settle the matter in a few minutes.<\/p>\n<h2>Swing gate, sliding gate: how to comply<\/h2>\n<p>The most problematic case is a swing gate that opens outwards. It is often chosen because there is not enough depth in the driveway or garden. But alternatives exist.  <\/p>\n<p>The most obvious: reverse the opening direction so the leaves open inwards onto your property. If space does not allow, a sliding gate is the best option. It runs along the fence without ever overhanging, either inside or outside. It is also the most common solution today for entrances along the street line.   <\/p>\n<h2>What if you are short on space?<\/h2>\n<p>Narrow plot, sloping driveway, boundary wall too close to the house\u2026 Constraints are common. A sliding gate, motorised or manual, remains the most suitable answer. It simply requires sufficient side clearance along the fence.  <\/p>\n<p>For those with neither depth nor side clearance, there are also inward-opening swing gates with asymmetrical leaves (one large + one small), which reduce the required footprint.<\/p>\n<h2>Act before you are forced to<\/h2>\n<p>Bringing things into compliance on your own initiative is always better than receiving a formal notice.
