Maximum height, authorized materials, clearance at ground level&#8230; Here is what the law actually requires and how to comply without unpleasant surprises.   <\/p>\n<h2>What exactly is the fencing law?<\/h2>\n<p>The fencing law stems from the law of February 2, 2023, aimed at limiting the fencing of natural areas. It addresses a concrete problem: the proliferation of impassable fences in forests and natural zones, particularly in Sologne. These wire fences blocked wildlife movement and fragmented ecosystems.  <\/p>\n<p>The law therefore regulates fences installed in natural and forest areas to ensure free movement of animals. It does not concern your suburban garden in a housing development, but rather land located in natural zones (N) or agricultural zones according to local planning documents. If your property is located in this type of zone, the new rules apply to you.  <\/p>\n<h2>What are the height and ground clearance rules?<\/h2>\n<p>This is the heart of the regulation. The law sets two precise requirements to allow animals to pass: <\/p>\n<ul>\n<li><strong>Maximum height of 1.20 meters<\/strong> above ground for the fence<\/li>\n<li><strong>Minimum clearance of 30 centimeters<\/strong> between the bottom of the fence and the ground<\/li>\n<\/ul>\n<p>This 30 cm clearance is what allows small wildlife (foxes, badgers, hares, hedgehogs) to move freely under the fence. The height limited to 1.20 m prevents creating an impassable barrier for larger animals such as roe deer or red deer. <\/p>\n<p>These fences must also be free of any devices dangerous to wildlife, such as spikes or barbed wire at the lower section.<\/p>\n<h2>Which materials are authorized and which are prohibited?<\/h2>\n<p>The law requires natural or traditional materials in the areas concerned. The objective is twofold: allow animals to pass and preserve the landscape character of natural zones. <\/p>\n<p>Wood, wide-mesh wire fencing that allows small wildlife to pass, or traditional fences such as chestnut paling fences are preferred. Conversely, solid concrete panels, masonry walls, and any device forming a continuous and opaque barrier at ground level are to be avoided. The idea is not to prohibit fencing, but to fence intelligently, without cutting off ecological corridors.  <\/p>\n<h2>Who is affected by the 2027 deadline?<\/h2>\n<p>All fences installed after February 2, 2023, must already comply with these rules. For existing installations prior to this date, the law allows a grace period: you have until January 1, 2027, to bring them into compliance. <\/p>\n<p>However, certain fences benefit from an exemption. This applies to fences located less than 150 meters from a dwelling, those surrounding an operational building, or those installed for specific safety reasons (water catchment areas, for example). Fences over 30 years old may also be eligible for exemptions depending on the circumstances. If in doubt about your specific case, contact your town hall or the DDT (Departmental Directorate of Territories).   <\/p>\n<h2>How do you bring your fence into compliance?<\/h2>\n<p>Start by checking the zoning of your land. Consult the PLU (Local Urban Plan) or the municipal map of your commune to determine whether you are in a natural or forest zone. If so, measure your current fence: height and ground clearance.  <\/p>\n<p>If your installation exceeds 1.20 m or sits flush with the ground without leaving the regulatory 30 cm, you have two options. Either you raise your fence to create the necessary clearance at ground level, or you replace it with a compliant model. For wire fencing, choose flexible mesh fencing with suitable spacing that you can position at the correct height. Also remember to remove any dangerous devices such as barbed wire or spikes at the lower section.
