This is particularly the case in protected zones, conservation areas, or when the Local Urban Plan (LUP) requires it.  <\/p>\n<p>The LUP is your best ally. It sets local rules: maximum authorized height, accepted materials, required colors, distance from the road. In some municipalities, a wire mesh fence passes without issue but a solid wall is prohibited at the front. Consult it systematically to avoid having to redo your installation at your own expense.   <\/p>\n<ul>\n<li>Request the alignment order to know the boundary with the public road<\/li>\n<li>Check the LUP at the town hall or on your municipality&#8217;s website<\/li>\n<li>File a prior declaration if required<\/li>\n<li>Have your land surveyed by a licensed surveyor if in doubt about boundaries<\/li>\n<\/ul>\n<h2>Shared or Private Fence: Knowing the Difference<\/h2>\n<p>With your neighbor, two situations exist. A private fence is installed entirely on your land: you finance it alone and you are the sole owner. A shared fence is placed on the exact dividing line between the two properties. In this case, installation and maintenance costs are split equally.   <\/p>\n<p>This distinction has concrete consequences. A shared fence cannot be modified, raised, or removed without your neighbor&#8217;s agreement. Conversely, on a strictly private fence, you decide alone, within LUP compliance. The classic mistake is placing a fence right on the boundary thinking you&#8217;ll save space, then finding yourself stuck for the slightest change. As long as no one contests it, all is well. But the day your neighbor challenges your fence&#8217;s location, without an official boundary survey, it&#8217;s your word against theirs.  <\/p>\n<p>The boundary survey is carried out by a licensed surveyor, the only professional authorized to legally establish land boundaries. When done amicably and signed by both parties, it is definitively binding. It represents a cost, certainly, but it&#8217;s little compared to legal proceedings that can drag on for years. In municipalities with fewer than 50,000 inhabitants, a fence can reach 2.60 meters, and 3.20 meters in larger cities. But these figures are rarely the right ones: the LUP almost always takes precedence and often imposes lower heights, sometimes 1.80 meters or less along roads.  <\/p>\n<p>Also watch for road visibility. Near intersections, exits, or bends, the municipality may limit your fence height for safety reasons. A hedge or opaque panel that is too high and blocks the view can be held against you and subject to an enforcement notice. Check this point whenever your land faces an intersection or busy road.   <\/p>\n<h2>What to Do in Case of Disagreement with a Neighbor or the Municipality<\/h2>\n<p>If a conflict arises, prioritize dialogue above all. Many disputes are resolved through discussion, especially when each party has official documents in hand: alignment order, boundary survey, planning permission. Presenting concrete evidence often defuses tension.  <\/p>\n<p>When dialogue is not enough, recourse to a justice conciliator is free and often effective. They intervene before any legal proceedings and allow an agreement to be reached without lawyer fees. For a dispute with the municipality, first send a letter to the planning department, then consider administrative recourse if necessary.
